This text is a general information and preparation sample. For a concrete customer/business relationship, the necessary party information, permissions, acceptance and, if any, pre-payment documents must be separately completed; displaying this page does not create a contract or mean that permission has been granted.
This text contains explanations on the usage and legal processes of the NEFES Ajansı service. In each section, data, authority and party responsibilities are assessed within their own scope.
Scope and person's rights
Using a person's face, voice, name, or an image that makes them recognizable in business promotion or in NEFES's portfolio may be assessed under personality rights and personal data protection legislation. A business's photo use permission does not automatically cover the rights of everyone in the frame.
Images of employees, customers, visitors, models and children carry separate risks. Consent and representation matters concerning children are assessed separately under law.
Information to be provided to the person
- The data controller carrying out the processing and the communication channel.
- Which photo/video/voice will be used and for what purpose.
- Publication channels and any paid advertising use, if applicable.
- The nature of any AI-based recreation, editing or voice generation, if applicable.
- Duration of use, third-party recipients and any transfer abroad, if applicable.
- Application, correction, deletion and withdrawal rights, to the extent applicable by law.
Sample consent declaration
“I have read the explanation regarding the use of my image/voice in the media content clearly shown and defined to me, for the stated purpose, duration and channels. I grant my consent of my own free will to the extent necessary for the relevant use.”
This sample does not mean that all processing activities must necessarily be based on explicit consent; the appropriate legal basis is analyzed separately for each case. Mandatory consent tied to employment hierarchy or a service condition may affect the assessment of free will.
Consent evidence to be recorded and withdrawal
When consent is obtained, the person, work/file identity, text version, purpose of use, selected publication channels, date and declaration of will are, where possible, linked to a written or equivalent record. If the person withdraws their notice or objects, the legal status of the publication is reassessed.
Where consent is absent or uncertain for images of real persons, NEFES may stop publication of the relevant content, and may choose anonymization or a different visual use. Personal rights and copyright ownership continue to apply.
