Site and Panel Terms of Use

Parties, scope and binding effect

These terms are offered by TRADE YAZILIM SANAYİ VE TİCARET LİMİTED ŞİRKETİ ("NEFES") for the use of nefesajans.com and the related business panel. The service brand is NEFES Ajansı; the trade name of the contracting party does not change.

Binding provisions on the panel account and paid service apply when the current terms are clearly presented to the user and their acceptance is duly obtained. Merely visiting the site does not create a paid social media agency subscription.

Nature of the service

NEFES is a managed social media agency service aiming to bring together, for businesses, visual/video content, creative planning, supported official social network connections, content review and publishing processes. Which features are available depends on the package purchased, platform permissions and live activation status.

The site may contain a sample customer panel, synthetic workspace, trial content or design preview. Demo data is not real customer performance, automatic publishing success or a revenue guarantee.

Account, authority and security

A person who opens an account or accepts the contract on behalf of a business must be authorized to represent that business. Phone verification or access to a Google account alone does not prove signing authority on behalf of a company.

The user must protect their own verification tool, must not gain unauthorized access to another's account, and must not share authentication codes. Where security breaches are deemed necessary, NEFES may temporarily restrict access.

Free trial and content upload

In the two-photo trial flow, the user must upload images that belong to their own business or that they are authorized to use. Without permission, private images of third parties, identity documents, specially protected health data, or media whose copyrights belong to others must not be uploaded.

Free samples may be provided within the limits of capacity and technical suitability; no trial is guaranteed to produce video of a specific quality or to be published on Instagram. Uploading a file does not grant NEFES permission to publish it in its own advertising.

AI-assisted production and approval

When automated systems are used for image, video and text production, factual accuracy and brand fidelity must be checked. Unverified claims about real menus/prices/rooms/venues/hair or beauty results, the product in the photo, and third parties are not automatically accepted as true.

Artificially generated humans/crowds are marked as scenarios where appropriate. Critical content is not published without approval; authority for publishing or for third-party accounts is separately obtained.

Prohibited use and intellectual property

Illegal content, misleading price/sales statements, fake customer reviews, unauthorized third-party images, copyright infringement, spam, interference with network security or unauthorized account connections are prohibited.

The customer retains its rights over its own brand and source files. Rights over NEFES's original interface, marks, design and software remain reserved. Usage/reproduction rights for delivered content are determined by the binding service agreement.

Paid service, changes, liability

Paid subscriptions, package scope, content quantities, payment, refunds, renewal and termination terms are explained in the B2B Agency Service Agreement and order summary accepted separately. General terms alone are not used as a basis for collecting fees from users.

Technical outages, API permissions or version changes on social platforms may affect the service. This does not eliminate NEFES's statutory liability arising from its own fault. No guarantee of definite sales, access, follower or booking increases is given.

Turkish law applies to disputes; the competent authority is determined according to the status of the parties and mandatory legal provisions. Contact: info@nefesajans.com.
