This text is a general information and preparation sample. This text contains explanations on the usage and legal processes of the NEFES Ajansı service. In each section, data, authority and party responsibilities are assessed within their own scope.
Why is a separate permission required?
The fact that a business's visuals are publicly available on its social media account does not automatically provide a license or personal permission for NEFES to republish the same visuals in its own marketing showcase or advertising.
The customer's authorization to produce content for their own account and NEFES's authority to showcase this work as a sample study rest on different purposes. For showcase use, the business's separate and recordable consent is required.
Elements to be defined in the permission form
- Business name, authorized representative and contact details of the permitting business.
- Which photos, videos, logos, brand names or works are covered by the permission (by file or job ID).
- Usage channels: NEFES website, social showcase, portfolio, digital presentation and/or separately selected paid advertising.
- Method of use: cropping, color/light correction, AI-assisted animation, text/logo overlay, before-and-after comparison.
- Duration of use, geographic scope, whether the source permission is free or paid, and, if necessary, the removal request procedure.
- How the separate rights of any recognizable persons in the image will be respected.
Facts to be protected
NEFES aims not to misleadingly alter original logo and signage identity, product and menu information, portions, the distinctive features of the venue, and real service results.
Subsequently produced human or fictional crowds may not be presented as real customers; appropriate disclosure and labeling are applied.
Sample explicit permission sentence
“I permit the use of the brand and visuals belonging to the business I represent as its authorized representative, identified in this consent by file or link, in the portfolio/sample work areas of NEFES Ajansı, limited to the specified period and channels. This permission does not eliminate the legal rights of real persons in the visuals.”
If this text is used, the concrete business name, files, duration, channel, type of use and approval date must also be recorded. The existence of a public template here does not mean that any business has given consent.
Withdrawal of permission and author rights
Application to change or remove permission limits info@nefesajans.com may be submitted via. Statutory provisions on personality rights, the Turkish Personal Data Protection Law (KVKK) and author rights remain reserved.
If the original copyright holder of the visual is a photographer or agency other than the business, the scope of the business's authority will be separately verified.
